| dc.description.abstract | ความตกลงหุ้นส่วนทางเศรษฐกิจภาคพื้นแปซิฟิก หรือ Trans-Pacific Partnership Agreement หรือ (TPP) เป็นความตกลงการค้าและการลงทุนระดับภูมิภาครูปแบบใหม่ที่มีเนื้อหาซับซ้อนและครอบคลุมมากกว่าความตกลงขององค์การการค้าโลก จนอาจเปิดโอกาสให้อุตสาหกรรมยาสูบหรือบริษัทบุหรี่ข้ามชาติ สามารถเข้ามาแทรกแซงการกำหนดนโยบายและกฎหมายควบคุมยาสูบของรัฐภาคี แม้ว่ารัฐภาคีจะสามารถเลือกที่จะไม่นำกระบวนการระงับข้อพิพาทระหว่างผู้ลงทุนกับภาครัฐ (Investor-State Dispute Settlement - ISDS) มาใช้กับกรณีผลิตภัณฑ์ยาสูบได้ แต่ข้อยกเว้นดังกล่าวก็ครอบคลุมเฉพาะข้อบทที่ว่าด้วยการลงทุนเท่านั้น มิได้ครอบคลุมไปถึงข้อบทอื่นใน TPP นอกจากนี้ เนื้อหาข้อบทบางเรื่องของ TPP อาจส่งผลเสียต่อการควบคุมยาสูบของไทย และเปิดช่องให้อุตสาหกรรมยาสูบหรือบริษัทบุหรี่ใช้เป็นข้ออ้างในการที่จะไม่ปฏิบัติตามกรอบอนุสัญญาองค์การอนามัยโลกว่าด้วยการควบคุมยาสูบ (WHO Framework Convention on Tobacco Control - FCTC) หรือทำให้มีคดีพิพาททางการค้าที่เกี่ยวกับกฎหมายหรือมาตรการการควบคุมยาสูบเพิ่มมากขึ้น | th_TH |

| dc.description.abstractalternative | The Trans-Pacific Partnership Agreement (TPP) is a comprehensive model of regional trade and investment agreement. As a complex and comprehensive new generation of trade agreement, tobacco industry or transnational tobacco companies would employ TPP to interfere with tobacco control policy and law of the State Parties. The State Party may not adopt the Investor-State Dispute Settlement (ISDS) with respect to claims challenging a tobacco control measure; however, such exception provision covers only the investment chapter. In sum, some of TPP’s provisions may have negative impact on tobacco control in Thailand and tobacco industry may not comply with the WHO Framework Convention on Tobacco Control (FCTC) or threaten the government by claiming the litigation or trade disputes in order to undermine tobacco control measures. | en_US |
